Rolling papers in the UK: age 18, the 2026 Act and what changes on 1 January 2027
Cigarette papers are age-restricted at 18 today. From 1 January 2027 the Tobacco and Vapes Act 2026 replaces that with a birth-date test. What changes.

The United Kingdom is the market Skins is built in, and it is about to change the rule that every counter has applied for two decades. This note sets out the position today, the change on 1 January 2027, the items in the 2026 Act that are still waiting for a commencement date, and the differences between the four nations. Rolling papers are a tobacco accessory. Skins sells papers only and makes no claims about cannabis. The note is information, verified on 5 September 2026, not legal advice; confirm with counsel before acting on it.
Today: 18, as cigarette papers
In England and Wales, section 7 of the Children and Young Persons Act 1933 makes it an offence to sell "any tobacco or cigarette papers" to a person under 18, the age having been raised from 16 in 2007. Scotland applies the same age through section 4 of the Tobacco and Primary Medical Services (Scotland) Act 2010, with a statutory age-verification defence, and Northern Ireland through Article 3 of the 1978 Order, which also makes proxy purchase an offence. Skins rates all three high confidence.
What is notable is the wording. Rolling papers are not tobacco products in UK law. Section 1 of the Tobacco Advertising and Promotion Act 2002 defines a tobacco product as one consisting wholly or partly of tobacco, and the Tobacco Products Duty Act 1979 uses a similar list, so papers sit outside the advertising ban and outside tobacco duty. Instead the law names them separately, as cigarette papers, and restricts them in their own right. That separate name runs all the way through the 2026 Act, and it is why commodity 4813 10 00 00 carries 0 percent duty and 20 percent VAT and nothing else.
From 1 January 2027: a birth date, not an age
The Tobacco and Vapes Act 2026 received Royal Assent on 29 April 2026. Section 1 reads: it is an offence to sell any of the following to a person born on or after 1 January 2009: a tobacco product, a herbal smoking product, cigarette papers. Section 50 defines cigarette papers as anything intended for encasing tobacco or herbal smoking products so they can be smoked, which covers a Skins leaf squarely. Section 52 amends the Scottish Act to the same test and Part 3 amends the Northern Ireland Order. Under section 175, the age-of-sale sections commence on 1 January 2027.
The practical effect is a different question at the counter. Today the check is "18 or over". From 1 January 2027 it is "born before 1 January 2009", and the answer to that question never changes for a given person. Someone born on 1 January 2009 turns 18 on 1 January 2027 and can never be sold cigarette papers in the UK. Age verification, in store and online, therefore has to check a date of birth against a fixed cut-off rather than an age, and Challenge 25 practice needs to carry the new question. The rule stops being about how old someone is and starts being about when they were born. Every till, every website, every training card has to ask the new question.

Part 6 is the item to watch. Sections 118 to 128 list cigarette papers among the products whose advertisements may not be published, designed, printed or distributed, with defences for trade-to-trade communication and replies to individual requests, a specialist-tobacconist exception and a point-of-sale display exclusion. None of it was in force at Royal Assent; it commences by regulations, and no date had been set. Skins rates the timing medium and the content high, and its planning assumes that UK brand advertising will close and that trade, retailer and owned channels will remain.
Marketing today: CAP Code section 21
Until Part 6 commences, non-broadcast marketing for rolling papers is governed by CAP Code section 21, enforced by the ASA, and unusually the code reaches point-of-sale material. The rules are short: no encouraging people to start smoking or smoke more; no suggestion that smoking is safe, natural, popular, glamorous or relaxing, or good for health; never depict anyone smoking; nothing targeted at or likely to appeal to under-18s, with anyone shown being and looking over 25; nothing that condones illegal drugs, where any drug reference is presumed a breach; nothing sexually titillating.
The ASA has upheld complaints against a major rolling-paper brand twice in recent years: in September 2025 for a paid social post that alluded to cannabis effects without naming them, and in February 2019 for posters using the word "safe" alongside youth-coded imagery. Both rulings explain the Skins register on this site: product, paper science, lab verification and stockists, and no one smoking anywhere. The paid platforms are closed to rolling papers by policy regardless, so the route to counters is the stock page, trade press and retailer channels.

Scotland is the one to read twice. Its display ban covers "smoking related products", which expressly include cigarette papers, in any place where tobacco products are sold. A Skins counter box in a Scottish tobacco-selling shop cannot be assumed to sit on open display; a papers-only shop is outside the ban.
Cannabis, stated once
Cannabis is a Class B controlled drug under the Misuse of Drugs Act 1971, with a narrow medicinal prescribing route since 1 November 2018 and no consumer market. Skins sells rolling papers only and makes no claims about cannabis in any market.
What a UK retailer should do now
Apply 18 with Challenge 25 today; prepare tills, training and any online checkout to ask the birth-date question from 1 January 2027; display the section 5 or section 6 notice from that date; in Scotland, treat papers as display-restricted where tobacco is sold; and keep marketing within CAP 21 until Part 6 arrives. The United States and Canada notes are the comparison: one fixed age, and one where the paper is a tobacco product outright. The UK is about to be neither.

01How old do you have to be to buy rolling papers in the UK?
